This website is operated by sweettoothshoppe.ca. Throughout the site, the terms “we”, “us” and “our” refer to sweettoothshoppe.ca. sweettoothshoppe.ca offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

Our store is hosted on Squarespace, Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

ORDER TERMS OF ACCEPTANCE AND COMPLETION

By purchasing designer desserts/products from Sweet Tooth Shoppe, it is assumed that you have read and accept our terms and conditions in full.  All dessert/product fees are non-negotiable and priced accordingly and relative to the type of dessert, albeit Chocolate Chip Cookie Crushes, Timeless Cupcakes, Texas-Style Sheet Cakes, Heart Cakes, Cookiewiches, Dots N Os and The MACC. Design fees for L’Atelier collections of Bespoke Cakes/Cupcakes/Luxe Bouqcakes and Designer Cookies will be based on specifications of design/details and size, color(s), special ingredients/supplies/embellishments, design hours, and processing/packaging relative to each design.

Once an order is placed, adjustments and alterations may only be made at the discretion of Sweet Tooth Shoppe, on an individual basis. We reserve the right to refuse any adjustments and alterations after an order is finalized.

All purchases through our website are subject to dessert availability. We may, in our sole discretion, limit or cancel the quantities offered on our website or limit the sales of our desserts, products or services to any person, household, geographic region or jurisdiction. We may exercise this right on a case-by-case basis.

Prices for our desserts/products are subject to change, without notice. Unless otherwise indicated, prices displayed on our website are quoted in Canadian dollars.

We reserve the right, in our sole discretion, to refuse orders, including without limitation, orders that appear to be placed by distributors or resellers. If we believe that you have made a false or fraudulent order, we will be entitled to cancel the order and inform the relevant authorities.

We have made every effort to display as accurately as possible the colors and images of our desserts/products that appear on our website. Thus, we cannot guarantee that your computer monitor's display of any color will be accurate.

We do not warrant that the quality of any desserts/products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the service will be corrected.

ORDERS

  1. All conditions in the ORDER TERMS OF ACCEPTANCE AND COMPLETION apply to all orders, whether placed online, email or phone.

  2. PRE-ORDER: All Sweet Tooth Shoppe desserts are available only through pre-order and are reserved upon payment and availability.

  3. DESIGN TIME: We highly recommend placing dessert orders for Dots N O’s, Chocolate Chip Cookies, The MACC, Timeless Cupcakes, Texas-Style Sheet Cakes, Heart Cakes & Cookiewiches, 1 week, in advance and all L’Atelier designs (Designer Cookies, Bespoke Cakes/Cupcakes/Luxe Bouqcakes) 2-3 weeks, in advance. For large group events (ex: weddings, graduation, etc) and corporate functions, etc, we highly recommend placing your order at least 2-3 months in advance of your date.

  4. EXPEDITED SERVICE: If availability is FULLY RESERVED, an expedited service request may be accepted on a case-by-case basis. All expedited service orders of Dots N O’s, Chocolate Chip Cookie Crushes, The MACC, Timeless Cupcakes, Texas-Style Sheet Cakes, Heart Cakes, Bouqcakes and Cookiewiches orders MUST be placed a minimum of 48 hours in advance and all L’Atelier designs (Designer cookies, Bespoke Cakes/Cupcakes/Luxe Bouqcakes), 1 week in advance. Note: An Expedited Service Fee may apply. Reserve your order as soon as possible and with the previously mentioned lead times in mind, as this will ensure we have the necessary resources, ingredients and supplies to meet your needs and timelines.

  5. L’ATELIER COLLECTIONS/DESIGNS: Sweet Tooth Shoppe’s exclusive, L’Atelier One-of-One collections of Bespoke Cakes/Cupcakes/Luxe Bouqcakes and Designer cookies are selected on a case by case basis. We take into consideration your collection request, all necessary supplies, special ingredients, timelines, design preparation & execution, studio time and design hours. With that, you MUST complete L’Atelier Enquiry Form, first. When your order request is confirmed, you will receive an email invitation for an exclusive, 1:1 collaboration with Designer, Anita, on your One-Of-One Collection.

    • While Sweet Tooth Shoppe strives to design magnificent one-of-one collections from our L’Atelier, we are happy to use images you provide to us as a source of inspiration, while also adding our originality and artistic flair.

MINIMUM QUANTITIES

Given all of Sweet Tooth Shoppe’s designer desserts are made fresh, on-demand, we have minimums in the following categories:

  • Seasonal Pies (whole pies)

PAYMENT

  • Sweet Tooth Shoppe will accept and confirm only those orders that have completed the required payment. All order payments are required as follows:

    • 100% non-refundable order/retainer fee, if less than $250;

    • 50% non-refundable order/retainer fee, if more than $250; Balance is due 2 weeks prior to required delivery.

  • All online, phone and email orders MUST be paid for in full, within 48 hours of receiving the invoice, in order to ensure availability. We reserve the right to cancel any previous arrangement, if payment is not complete.

  • Check your order thoroughly before payment. If an inscription, detail or any other choice is left un-selected on your order, then we reserve the right to use our own discretion.

  • Acceptable forms of payment include debit/credit card (Visa, Mastercard, American Express), and/or Paypal upon checkout on the Sweet Tooth Shoppe website or via e-transfer.

CHANGES/CANCELLATIONS

Every L’Atelier design is a custom, One-of-One collection of Bespoke Cakes/Cupcakes/Luxe Bouqcakes and Designer Cookies. And like our L’Atelier collections/designs, all of Sweet Tooth Shoppe desserts, including Cookiewiches, Dots N Os, Timeless Cupcakes, Texas-Style Sheet Cakes, Heart Cakes, The MACC and Chocolate Chip Cookie Crushes, are made with the finest, premium ingredients and made fresh to order. As such, there is a considerable amount of preparation and time that goes into your order, in advance of the required date.

We understand that plans can change and will always strive to help you to make changes to your order date/time whenever possible.

All changes/cancellations must be made via email to getthecure@sweettoothshoppe.ca. Cancellations left on our voicemail will not be counted.

Cancellation instructions/fees are as follows:

  • Cancellation/Changes for L’Atelier Designs of Bespoke Cakes/Cupcakes/Luxe Bouqcakes, Designer Cookies: Changes and cancellations to these orders are accepted up until 12 prior to the date of delivery. You may make any changes that you wish to an order until 12 days before delivery. However, we are unable to make changes on orders after that time frame. Cancellations on orders given more than 12 days prior to delivery date will receive partial refund of 50% of final payment (retainer fee is non refundable). No refunds will be provided for orders that are cancelled with less than 12 days notice due to costs incurred by the initiation of an order.

  • Cancellation/Changes for Timeless Cupcakes, Texas-Style Sheet Cakes, Heart Cakes, Cookiewiches, Dots N Os, The MACC and Chocolate Chip Cookie Crushes: Changes and cancellations to these orders are accepted up until 5 days prior to the date of delivery. You may make any changes that you wish to an order until 5 days before delivery. However, we are unable to make changes on orders after that time frame. If an order is cancelled 5 days prior to delivery date, we reserve the right to issue only a 70% refund. If it is cancelled less than 5 days prior to delivery date, we reserve the right to issue only a 30% refund.

  • We reserve the right to refuse a refund of any order, should we deem it unreasonable.

DESIGN

  • While Sweet Tooth Shoppe strives to design magnificent one-of-one collections from our L’Atelier, we are happy to use images you provide to us solely as inspiration (not recreations or replications of other baker’s work) and add our uniquity and artistic flair.

  • Customer design specifications can be made via order enquiry form. Final designs and variants thereof are at the final discretion of Sweet Tooth Shoppe to ensure the best possible result for each individual customer.

  • All L’Atelier designs are priced based upon the complexity of the design, supplies, special ingredients, embellishments, design hours, and all other factors involved in the creative process.

ALLERGENS/SPECIAL DIETARY CONSIDERATIONS

Discuss with us any special dietary considerations, as we offer the below options, on a case-by-case basis, for L’Atelier Bespoke Cupcakes/Cakes/Luxe Bouqcakes, only:

Gluten Free; Egg Free; Lactose Free; Organic; Sugar Free; Low-Calorie/Fat-Free.

NOTE: This will incur a surcharge for relevant ingredients.

IMPORTANT NOTICE: Sweet Tooth Shoppe desserts are made using shared equipment which processes dairy, nuts, wheat and other ingredients. As such, we are not an allergy-free facility and do use ingredients/products that contain nuts, gluten, dairy, etc. While we do our best to prevent cross-contamination, we cannot guarantee cross-contamination under any circumstances.

For clients with severe allergies, please ensure to carefully read the dessert ingredients, for any allergens, before placing your order. Being aware of these terms and conditions, we strongly advise against consumption of the desserts, if such is the case. Doing so, is at your own risk.

NON-EDIBLE ITEMS

Some of our Bespoke Cakes/Luxe Bouqcakes may contain non-edible items, such as cake boards, dowels, ribbons, rosy picks, flower holders, cardettes, wire, etc. It is the client’s sole responsibility that there are removed prior to consumption.

DELIVERY

  • Sweet Tooth Shoppe operates on a direct to client (DTC) basis, and thus provides delivery services, only. Exceptions to this is a collection option, exclusively for those clients on THE LIST of our L’Atelier.

  • Delivery fees start at $5 for those clients within a 20 mile radius of Milton, Ontario and will increase beyond this radius. Fee are calculated based on distance traveled and will be quoted when the order is confirmed.

  • Sweet Tooth Shoppe will arrange date & time for delivery/collection (option extended only to our L’Atelier clients & for Luxe Bouqcakes), when the order is confirmed paid in full.

  • Delivery Days/Hours:

  • Once you have selected a delivery time, it is your responsibility to adhere to the chosen time and date.  Any rescheduled delivery times will be solely at Sweet Tooth Shoppe’s discretion and cannot be guaranteed under any circumstances.

  • Clients are responsible for supplying the correct delivery address information. Before you proceed to checkout and select a delivery time you will be required to acknowledge that someone will be there to accept the order during the available delivery time slots. We are not responsible for items left unattended. If there is no access to the building, your order will be returned to Sweet Tooth Shoppe. We will notify you and you will have 4 hours to collect the order. If you are not present upon delivery and do not collect the order upon designated time, within four hours thereafter, as determined by Sweet Tooth Shoppe, we will not refund the order.

  • We are open Monday, Tuesday, Thursday and Fridays. Wednesdays are reserved exclusively for L’Atelier Designs and Saturdays are reserved for weekend deliveries. Sundays and Wednesdays are not available as delivery dates, when you place your order:

    • If you order on Saturday, your earliest delivery date is the following Tuesday.

    • If you order on Sunday or Monday, your earliest delivery date is the following Wednesday.

    • If you order on Wednesday, your earliest delivery date is the following Monday.

    • In the event we are unable to fulfill your order on your selected delivery/collection date, we will contact you to let you know.

TRANSPORT

PRE-TRANSIT

Sweet Tooth Shoppe desserts are packaged in their appropriate size boxes to accommodate their quantity/size/circumference.

To prevent cakes from sliding around their base, cakes are placed on cake boards secured atop a non-slip mat and cupcakes are placed in cupcake boxes with individual cupcake holders.

To make buttercream cakes/cupcakes easier to handle during transit, they are chilled in the refrigerator the day before transport. This will prevent smudging/sinking of the cake due to warmer climate.

NOTE: Buttercream cakes/cupcakes can be frozen (upon request) before transport, for added ease of handling. You will need to ensure adequate time to thaw and reach room temperature before intended time of consumption/event.

TRANSIT

Inspect your dessert(s) on collection, once order delivery is complete and out of our possession, we assume that you are happy with the finished design(s) and Sweet Tooth Shoppe is no longer responsible should damage occur during transport or thereafter.

Additional Items Needed: Yoga mat, towel, or non-adhesive grip shelf liner

LEVEL SPOTS IN VEHICLE: Prior to transport, check the vehicle for flat, level spots. This is typically in the boot/trunk/passenger side floor. Avoid carrying in your lap while driving or placing on any of the passenger seats. They have varying heights/slants that will cause the desserts to drift/slide/topple and distort during transit.

For added stability and to prevent the dessert(s) from sliding during transit, we highly recommend that you place a non-skid/non-slip mat or liner like a yoga mat, towel, or non-adhesive grip shelf liner on the flat/level surface, followed by the dessert box.

TEMPERATURE IN/OUT OF VEHICLE: Keep the temperature inside and outside the car in mind. All dessert types should be kept cool to prevent melting of icing/buttercream of the dessert/sinking of cakes, specifically. If it’s a hot day outside, the air conditioning may not reach the trunk, so it might be safer to place the cake on the floor of the car to keep it cool. Avoid running errands and/or turning the ignition off when the dessert is in the car. It will melt, crack, slide, fondant will break and bend. If it is cold outside, ensure heat is not directed towards your cake.

In the event that buttercream may start to sweat, a dab of a paper towel should absorb it, without distorting the cake/cupcakes.

Keep in mind changes in temperature will create bubbles in cakes and is normal do not be alarmed, cakes are edible material and these things can occur.

DRIVING: Drive carefully and slowly. Avoid steep ramps, sudden stops, and quick starts. Be vigilant of speed bumps and sharp turns and take your time and brake sooner than necessary.

Dessert boxes should be carried from the bottom and NOT from the box sides, as that could damage the cake/cupcakes/cookies/cookiewiches/bouqcakes

BEST BEFORE DATE/STORAGE CONDITIONS

Sweet Tooth Shoppe uses all natural, premium ingredients. Therefore, for optimal freshness, taste, texture, and deliciousness, we recommend to consume your desserts within 24 hours. Otherwise, see guidelines below (NOTE: Desserts MUST be placed in airtight containers (*AT) for all scenarios, below):

Dots N Os: 1-2 days room temperature (only), cool & dry place (layer paper towel sheets in between donuts, to optimize moisture in donuts) & maintain softness. (*AT)

Designer Cookies/The MACC: 1-2 days room temperature, cool & dry place, up to 3 days refrigerator, up to 1 month freezer (Cookies will lose moisture, become drier and risk color bleeds, over time). (*AT)

Chocolate Chip Cookie Crushes/Cookiewiches: 1-2 days room temperature, up to 2 days refrigerator, up to 1 month freezer (cookies will soften in the freezer and lose their signature crispy edges, over time). (*AT)

Bespoke Cakes/Texas Style Sheet Cakes/Heart Cakes: 1-2 days room temperature, cool & dry place, up to 4 days refrigerator, up to 1 month freezer. (*AT)

Timeless Cupcakes/Luxe Bouqcakes: 1-2 days room temperature, cool & dry place, up to 4 days refrigerator, up to 1 month freezer. (*AT)

NOTE: For desserts that are placed in the freezer, when you are ready to consume them, let thaw overnight in the refrigerator. The next day: one hour before consumption, remove from refrigerator and bring to room temperature.

PEACE-OF-MIND/SATISFACTION

We pride ourselves in our quality of care, attention to detail, professionalism and optimizing our client’s experience. If you are in any way concerned with your order upon inspection/delivery/collection, please inform Sweet Tooth Shoppe through getthecure@sweettoothshoppe.ca, within one 24 hours of delivery/collection. Include the reasons why you are concerned and any supplemental photographs. This will allow us to address it in a timely manner.

While we do not offer refunds/exchanges after delivery of your order, we will ensure we work with you to find the best remedy.

At our discretion, resolutions may include:

  • a remake;

  • a percentage off of your next order; or,

  • Sweet Tooth Shoppe credit to be used against a future purchase with us. As taste and texture are subjective, we would not offer credit, money back, or a percentage off for these as reasons.

We will always endeavour to deliver within the given time slot, however, delivery timings can not be guaranteed when dealing with unforeseen situations en route, such as traffic and accidents. Refunds will not be given for delayed deliveries.

SEASONALITY

We are a seasonally-operated dessert boutique. What this means is, while we LOVE You, our clients, we also LOVE our Family and thus strive to maintain a healthy balance between time at Sweet Tooth Shoppe and time with our Family. Operating seasonally allows us the opportunity to have more precious, undivided time with them.

That said, April to October is reserved for all order types. October to April is reserved specifically for catering large groups/events & corporate functions, with a minimum order of $500. The exception to this is L’Atelier collections and designs for popular occasions/holidays.

PROMOTIONS, SWEEPSTAKES, CONTESTS, SURVEYS, CHALLENGES, ACTIVITIES
